AEON MEMBER CARD Membership Agreement Terms and Conditions
- 1 Membership

- 1.1 AEON MEMBER CARD Membership (“the Membership”) is open to all persons who are 15 years of age or above.
- 1.2 AEON MEMBER CARD (“the Card”) can be used in AEON STYLE, AEON, AEON SUPERMARKET, Mono Mono, Living PLAZA by AEON, Bento Express by AEON, Molly Fantasy, Cantevole, La Bohéme Bakery、AEONCITY and other stores which AEON Stores (Hong Kong) Co., Ltd. shall stipulate from time to time (together hereinafter referred to as “AEON Stores”).
- 1.3 Applicants of the Membership shall complete the application process as AEON Stores may decide from time to time, including but not limited to completing a registration/application form and/or providing certain personal data. Incomplete or inaccurate forms might not be processed by AEON Stores. AEON Stores reserves the right to approve or reject any application in its sole discretion without giving any reason.
- 1.4 AEON MEMBER CARD Member (“the Member”) must submit the required information within two months from the time of application. Otherwise, the Card will be temporarily suspended without prior notification. The Card shall be re-activated upon all required information has been received by AEON Stores.
- 1.5 The original completed registration/application form(s) are non-returnable after submitted.
- 1.6 The Membership is valid for one year.
- 1.7 Where a Member has more than one or other membership(s) with AEON Stores, the Member may select/use only one of the memberships (and corresponding benefits) in each transaction.
- 1.8 The Membership can be renewed by completing a renewal form and upon payment of a renewal fee (or in such other manner as AEON Stores may decide from time to time). AEON Stores reserves the right to reject an incomplete or inaccurate renewal form.
- 1.9 The Card belongs to the designated Member only, and is not transferable and is restricted for use in HONG KONG only.
- 2 Membership Card

- 2.1 Upon acceptance of application, AEON Stores will issue “the CARD” to each Member. The use by the Member of the Card constitutes unconditional acceptance of these terms and conditions.
- 2.2 As the Card, among other things, is the principal means by which AEON Stores identifies the Member, allows the Member access to the Member’s accounts and to redeem Bonus Points, the Member is advised to take good care of the Card and any other information relating to the Membership with reasonable precautions against loss or unauthorized use. If a Member’s Card and/or any other information or device(s) relating to a Member’s Membership is lost or stolen, or the Member has sufficient reason to believe that his/her Membership may have been used by, or account and password have been disclosed to, an unauthorized party, the Member must send an email to aeonmember@aeonstores.com.hk with his/her registered email information to request for temporary account suspension immediately or contact the Member Service Hotline 2565-3656, or report to the Customer Service Counters in person. AEON Stores shall not be responsible or liable for any loss or damage (including Bonus Points, benefits and cash coupons) arising from the unauthorized use of or access to the lost or stolen Card or information or devices relating to a Member’s Membership.
- 2.3 Holder of AEON Visa Card, AEON MasterCard, AEON Union Pay Card or AEON JCB Card, (collectively referred to as “AEON Credit Card”) shall apply for a separate Member Card in accordance with the application process designated by AEON Stores from time to time to obtain (Cannot use AEON Credit Card as a substitute for the Card) to enjoy the full benefits offered by our Privilege Benefit Scheme.
- 3 Replacement of the Card

- 3.1 If the Card is lost, stolen, damaged or fails to function properly, the Member may apply for a replacement at our Customer Service Counters. A re-issuing fee may be charged for replacement of the Card. Re-issuing fee is currently HK$10 and is subject to review by AEON Stores from time to time.
- 4 Amendments
-
- 4.1 AEON Stores reserves the right, in its sole discretion, to modify the Membership, fees, benefits offered and other features, including these terms and conditions, or to terminate the AEON MEMBER CARD program at any time with or without notice and AEON Stores will not be liable for any loss or damages resulting therefrom.
- 4.2 AEON Stores will post the amended terms and conditions at stores and/or on the company’s website. AEON Stores will not issue separate notice of amendment(s). Members are responsible for checking the amendment(s).
- 4.3 Continued participation in the AEON MEMBER CARD program and/or use of the Card will be deemed as acceptance of any amendment(s) to these terms and conditions. If any Member does not agree with such amendment(s), such Member's sole remedy is to cease participating in the AEON MEMBER CARD program and cease using the Card.
- 4.4 In case of any disputes, AEON Stores has the right to make the final decision at its sole discretion.
- 5 Fees

- 5.1 Members have to pay the following fees:-
(i) application fees upon initial application of the Membership;
(ii) renewal fees upon renewal of the Membership;
(iii) re-issuing fees upon replacement of the Card.
- 5.2 All fees are non-refundable in any circumstances.
- 6 Bonus Points Reward Scheme

- 6.1 Member must present his/her Card or any other form of accepted Member identification method by AEON, as the case may be at the time of purchase with specific payment media to enjoy member shopping privileges and/or earn Bonus Points.
- 6.2 Bonus Points will be calculated and may be redeemed in accordance with AEON Stores’ Privilege Benefits Scheme prevailing from time to time and posted at stores.
- 6.3 Bonus Points will not accrue until AEON Stores has accepted the Membership application by issuing the Card to the Member or indicated acceptance of Membership through electronic media, as the case may be.
- 6.4 AEON Stores may from time to time enter into arrangements with other entities whereby members may accumulate Bonus Points from the use of services of or the purchase of goods from such other entities subject to such terms and conditions as AEON Stores may impose with respect to the accumulation of such Bonus Points.
- 6.5 Members may check their accrued Bonus Points at Customer Service Counter, AEON Mobile, "AEONCITY" through the internet and/or from their sales receipt, all of which are provided for the member's reference only and might not necessarily indicate the correct balance of member's account. AEON Stores’ records shall (in the absence of manifest error) be conclusive in showing the correct balance.
- 6.6 Bonus Points will normally be credited to a member's account after 2 business days from the day when the member makes the purchase with his/her Card.
- 6.7 Bonus Points accrued are redeemable by the Member him/herself only and not transferable to any other person, and cannot be transferred to another Member's account or another account of the same Member. Upon the death of a Member, all remaining Bonus Points will be cancelled automatically.
- 6.8 All Bonus Points accrued will be cancelled upon the expiry of the Membership.
- 6.9 Bonus Points accrued shall be used no later than one calendar month immediately following expiry of the Membership; otherwise, all remaining Bonus Points will be forfeited thereafter.
- 6.10 To redeem the Bonus Points, the Member must:-
(i) Show his/her Card and sign a receipt for the redemption in person at the Customer Service Counter inside AEON Stores; or
(ii) Log in at the member zone of AEON Mobile, complete the redemption process by following the procedure as prompted therein, and redeem benefit, gift(s) or coupon(s) in accordance with the instructions set out therein; or
(iii) show his/her Card at the store cashier or any other form of accepted Member identification method by AEON when making a purchase as the case may be or as the particular redemption program may specify.
- 6.11 In case of Bonus Points Replenishment request, the Member must bring the same day receipt to Customer Service Counter; otherwise no Bonus Points could be accrued for the purchases. In case of any dispute, AEON Stores’ decision shall be final.
- 6.12 In case of refund request, the Bonus Points accrued from the refunded product(s) will be deducted from the Member’s account. AEON Stores reserves the right to take legal action and deduct Bonus Points from Member’s account if AEON Stores reasonably suspects that such Bonus Points were obtained via dishonest means or misconduct.
- 7 Delivery Service

- 7.1 The Member can enjoy Free Delivery Service upon making purchase (Licensees’ merchandise to be excluded) of designated amount or such other amount as specified by AEON Stores from time to time.
- 7.2 Free Delivery Service is limited to Hong Kong territory only and subject to the Delivery Service Terms and Conditions posted at stores.
- 8 Personal Data (Privacy)

- 8.1 The personal data supplied by the Members are required for the operation of AEON MEMBER CARD program, the Privilege Benefits Scheme and other privilege(s) which AEON Stores may from time to time obtain from or arrange with our business partners in joint promotion for the benefit of the Member. Failure to supply personal data may result in AEON Stores being unable to provide the above services to the Member.
- 8.2 The Member agrees that all the personal data provided to AEON Stores and all information relating to the use of your Card may be used and retained by AEON Stores for:
i. processing an application for the Membership;
ii. management, operation and maintenance of the Membership management system;
iii. the daily operation of the services provided to the Members;
iv. imprinting the Member’s name on the Card;
v. communication of news and information by AEON Stores to Members;
vi. investigation of complaints, suspected suspicious transactions and ongoing research for service improvement and program development;
vii. designing services or related products for the Members' use;
viii. facilitating the issue of benefits to Members;
ix. meeting the requirements to make disclosure under the requirements of any law binding or under and for the purposes of any guidelines issued by other statutory authorities with which AEON Stores is required to comply.
- 8.3 Member further agrees that AEON Stores may disclose and transfer member’s personal data (whether within Hong Kong or abroad) to the following parties for the purposes as set out in Clause 8.2 above:
i. third party service providers, their agents and contractors, who provide administrative, telecommunications, computer, payment, printing or other services to AEON Stores in connection with the operation of its business including providing service to the Member and/or;
ii. any person to whom AEON Stores is under an obligation to make disclosure under the requirements of any law binding or under and for the purposes of any guidelines issued by regulatory or other authorities with which AEON Stores is required to comply.
- 8.4 All information will be managed in accordance with the Personal Data (Privacy) Ordinance and AEON Stores’ Privacy Policy.
- 8.5 AEON Stores intends to use your name, contact details (as per your preference) and month and year of birth to send you news, information, privileges and promotions (both in-store and online) regarding the following products and services offered by AEON Stores and/or our licensee shops and/or our business partners in joint promotion: supermarket goods, home appliances, electronic appliances, computers and accessories, furniture and homeware, audio visual, toys and stationery, baby products, health care products, fashion, accessories, clothing, leather goods and luggage, shoes, watch and jewelry, health care, hair, beauty and cosmetics, pet needs, food and beverage, catering, media, entertainment, logistics, transportation, travel and hotel, shopping malls, credit cards, telecommunications, banking, financial and insurance, tutorials, education, memberships, loyalty and reward programmes and our associated events. AEON Stores must obtain consent from the Members before doing so. Members may choose not to receive such communications by ticking the appropriate box in the application form. Members may, without charge, opt out from receiving direct marketing materials from AEON Stores by following the steps stipulated in the application form.
- 8.6 Members have the right to request to review and correct any personal data held by AEON Stores in accordance with the Privacy Policy. An administration fee may be charged for the processing of these requests. Members have the right to:
a. check whether AEON Stores hold any of your personal data;
b. access your personal data held by AEON Stores;
c. require us to correct any personal data which is inaccurate;
d. ascertain the privacy policy (from time to time) in relation to personal data and the type of personal data held by AEON Stores.
- 8.7 All requests for access to or correction of personal data or information regarding policies and practices and types of personal data held should be in writing and addressed to the Data Protection Officer: Sales Planning Department, AEON Stores (Hong Kong) Co., Limited, Units 07-11, 26/F, CDW Building, 388 Castle Peak Road, Tsuen Wan, New Territories.
- 8.8 AEON Stores may be unable to maintain or renew a Membership or the associated benefits if the Member fails to provide AEON Stores with up to date information. Members are responsible for keeping AEON Stores informed of their new telephone contact, correspondence and email addresses. AEON Stores is not responsible for any loss as a result of the Member's failure to inform AEON Stores of any change.
- 9 Termination

- 9.1 The Member may terminate his/her Membership at any time by returning in person his/her Card to our Customer Service Counters at which time any Bonus Points accrued will be cancelled. Membership fees paid will not be refunded on termination of the Membership.
- 9.2 Misconduct, fraud, misuse of AEON MEMBER CARD, its benefits or failure to follow these terms and conditions may result in the immediate termination of the Membership and cancellation of all Bonus Points. AEON Stores reserves the right with or without notice and without giving reasons therefor to terminate the Membership at which time all Bonus Points accrued will be cancelled.
- 9.3 AEON Stores reserves the right, at any time and at its absolute discretion and without giving prior notice or reasons therefor, to
(i) Amend, withdraw or terminate any privilege(s) issued to a Member pursuant to the Membership or otherwise;
(ii) Suspend or cease to provide any service(s ) and/or privilege(s) originally enjoyed by the Member without compensation whatsoever; or
(iii) Terminate the Membership (and all Bonus Points accrued).
- 10 Liability

- 10.1 AEON Stores shall not be liable to any Member for any loss, damages or expenses of any kind whatsoever arising out of or in connection with the Membership, the use of the Card, AEON Mobile or its benefits, including but not limited to the use of personal data, mistakes or fraud by any person in redeeming a benefit, whether AEON Stores is negligence or otherwise.
- 10.2 AEON Stores’ liability in contract, tort or otherwise in respect of any claim arising out of acts or omissions relating to the Membership or the use of the Card or AEON Mobile shall be limited to re-crediting the value of the Bonus Points entitled to by the member in connection with which the matter arises.
- 10.3 AEON Stores will not be liable for any loss or damage arising out of the product or service provided by any other entities in connection with the use of the Card or AEON Mobile.
- 10.4 AEON Stores’ decision in respect of any such complaint or dispute shall be final and binding on the member and AEON Stores shall not be required to give any reason for such decision.
- 11 Invalidity

- 11.1 The invalidity, illegality or unenforceability of any provision of these terms and conditions under the laws of any jurisdiction shall not affect its validity, legality or enforceability under the laws of any other jurisdiction nor the validity, legality or enforceability of any other provisions herein contained.
- 12 Jurisdiction

- 12.1 These terms and conditions and the relationship between AEON Stores and each Member are governed by the laws of The Hong Kong Special Administrative Region. AEON Stores and each Member submit to the non-exclusive jurisdiction of the Hong Kong Courts.
**Should there be any discrepancy between the English and the Chinese versions of these terms & conditions, the English version shall prevail.

- 3.1 If the Card is lost, stolen, damaged or fails to function properly, the Member may apply for a replacement at our Customer Service Counters. A re-issuing fee may be charged for replacement of the Card. Re-issuing fee is currently HK$10 and is subject to review by AEON Stores from time to time.
- 4 Amendments

- 4.1 AEON Stores reserves the right, in its sole discretion, to modify the Membership, fees, benefits offered and other features, including these terms and conditions, or to terminate the AEON MEMBER CARD program at any time with or without notice and AEON Stores will not be liable for any loss or damages resulting therefrom.
- 4.2 AEON Stores will post the amended terms and conditions at stores and/or on the company’s website. AEON Stores will not issue separate notice of amendment(s). Members are responsible for checking the amendment(s).
- 4.3 Continued participation in the AEON MEMBER CARD program and/or use of the Card will be deemed as acceptance of any amendment(s) to these terms and conditions. If any Member does not agree with such amendment(s), such Member's sole remedy is to cease participating in the AEON MEMBER CARD program and cease using the Card.
- 4.4 In case of any disputes, AEON Stores has the right to make the final decision at its sole discretion.
- 5 Fees

- 5.1 Members have to pay the following fees:-
(i) application fees upon initial application of the Membership;
(ii) renewal fees upon renewal of the Membership;
(iii) re-issuing fees upon replacement of the Card.
- 5.2 All fees are non-refundable in any circumstances.
- 6 Bonus Points Reward Scheme

- 6.1 Member must present his/her Card or any other form of accepted Member identification method by AEON, as the case may be at the time of purchase with specific payment media to enjoy member shopping privileges and/or earn Bonus Points.
- 6.2 Bonus Points will be calculated and may be redeemed in accordance with AEON Stores’ Privilege Benefits Scheme prevailing from time to time and posted at stores.
- 6.3 Bonus Points will not accrue until AEON Stores has accepted the Membership application by issuing the Card to the Member or indicated acceptance of Membership through electronic media, as the case may be.
- 6.4 AEON Stores may from time to time enter into arrangements with other entities whereby members may accumulate Bonus Points from the use of services of or the purchase of goods from such other entities subject to such terms and conditions as AEON Stores may impose with respect to the accumulation of such Bonus Points.
- 6.5 Members may check their accrued Bonus Points at Customer Service Counter, AEON Mobile, "AEONCITY" through the internet and/or from their sales receipt, all of which are provided for the member's reference only and might not necessarily indicate the correct balance of member's account. AEON Stores’ records shall (in the absence of manifest error) be conclusive in showing the correct balance.
- 6.6 Bonus Points will normally be credited to a member's account after 2 business days from the day when the member makes the purchase with his/her Card.
- 6.7 Bonus Points accrued are redeemable by the Member him/herself only and not transferable to any other person, and cannot be transferred to another Member's account or another account of the same Member. Upon the death of a Member, all remaining Bonus Points will be cancelled automatically.
- 6.8 All Bonus Points accrued will be cancelled upon the expiry of the Membership.
- 6.9 Bonus Points accrued shall be used no later than one calendar month immediately following expiry of the Membership; otherwise, all remaining Bonus Points will be forfeited thereafter.
- 6.10 To redeem the Bonus Points, the Member must:-
(i) Show his/her Card and sign a receipt for the redemption in person at the Customer Service Counter inside AEON Stores; or
(ii) Log in at the member zone of AEON Mobile, complete the redemption process by following the procedure as prompted therein, and redeem benefit, gift(s) or coupon(s) in accordance with the instructions set out therein; or
(iii) show his/her Card at the store cashier or any other form of accepted Member identification method by AEON when making a purchase as the case may be or as the particular redemption program may specify.
- 6.11 In case of Bonus Points Replenishment request, the Member must bring the same day receipt to Customer Service Counter; otherwise no Bonus Points could be accrued for the purchases. In case of any dispute, AEON Stores’ decision shall be final.
- 6.12 In case of refund request, the Bonus Points accrued from the refunded product(s) will be deducted from the Member’s account. AEON Stores reserves the right to take legal action and deduct Bonus Points from Member’s account if AEON Stores reasonably suspects that such Bonus Points were obtained via dishonest means or misconduct.
- 7 Delivery Service

- 7.1 The Member can enjoy Free Delivery Service upon making purchase (Licensees’ merchandise to be excluded) of designated amount or such other amount as specified by AEON Stores from time to time.
- 7.2 Free Delivery Service is limited to Hong Kong territory only and subject to the Delivery Service Terms and Conditions posted at stores.
- 8 Personal Data (Privacy)

- 8.1 The personal data supplied by the Members are required for the operation of AEON MEMBER CARD program, the Privilege Benefits Scheme and other privilege(s) which AEON Stores may from time to time obtain from or arrange with our business partners in joint promotion for the benefit of the Member. Failure to supply personal data may result in AEON Stores being unable to provide the above services to the Member.
- 8.2 The Member agrees that all the personal data provided to AEON Stores and all information relating to the use of your Card may be used and retained by AEON Stores for:
i. processing an application for the Membership;
ii. management, operation and maintenance of the Membership management system;
iii. the daily operation of the services provided to the Members;
iv. imprinting the Member’s name on the Card;
v. communication of news and information by AEON Stores to Members;
vi. investigation of complaints, suspected suspicious transactions and ongoing research for service improvement and program development;
vii. designing services or related products for the Members' use;
viii. facilitating the issue of benefits to Members;
ix. meeting the requirements to make disclosure under the requirements of any law binding or under and for the purposes of any guidelines issued by other statutory authorities with which AEON Stores is required to comply.
- 8.3 Member further agrees that AEON Stores may disclose and transfer member’s personal data (whether within Hong Kong or abroad) to the following parties for the purposes as set out in Clause 8.2 above:
i. third party service providers, their agents and contractors, who provide administrative, telecommunications, computer, payment, printing or other services to AEON Stores in connection with the operation of its business including providing service to the Member and/or;
ii. any person to whom AEON Stores is under an obligation to make disclosure under the requirements of any law binding or under and for the purposes of any guidelines issued by regulatory or other authorities with which AEON Stores is required to comply.
- 8.4 All information will be managed in accordance with the Personal Data (Privacy) Ordinance and AEON Stores’ Privacy Policy.
- 8.5 AEON Stores intends to use your name, contact details (as per your preference) and month and year of birth to send you news, information, privileges and promotions (both in-store and online) regarding the following products and services offered by AEON Stores and/or our licensee shops and/or our business partners in joint promotion: supermarket goods, home appliances, electronic appliances, computers and accessories, furniture and homeware, audio visual, toys and stationery, baby products, health care products, fashion, accessories, clothing, leather goods and luggage, shoes, watch and jewelry, health care, hair, beauty and cosmetics, pet needs, food and beverage, catering, media, entertainment, logistics, transportation, travel and hotel, shopping malls, credit cards, telecommunications, banking, financial and insurance, tutorials, education, memberships, loyalty and reward programmes and our associated events. AEON Stores must obtain consent from the Members before doing so. Members may choose not to receive such communications by ticking the appropriate box in the application form. Members may, without charge, opt out from receiving direct marketing materials from AEON Stores by following the steps stipulated in the application form.
- 8.6 Members have the right to request to review and correct any personal data held by AEON Stores in accordance with the Privacy Policy. An administration fee may be charged for the processing of these requests. Members have the right to:
a. check whether AEON Stores hold any of your personal data;
b. access your personal data held by AEON Stores;
c. require us to correct any personal data which is inaccurate;
d. ascertain the privacy policy (from time to time) in relation to personal data and the type of personal data held by AEON Stores.
- 8.7 All requests for access to or correction of personal data or information regarding policies and practices and types of personal data held should be in writing and addressed to the Data Protection Officer: Sales Planning Department, AEON Stores (Hong Kong) Co., Limited, Units 07-11, 26/F, CDW Building, 388 Castle Peak Road, Tsuen Wan, New Territories.
- 8.8 AEON Stores may be unable to maintain or renew a Membership or the associated benefits if the Member fails to provide AEON Stores with up to date information. Members are responsible for keeping AEON Stores informed of their new telephone contact, correspondence and email addresses. AEON Stores is not responsible for any loss as a result of the Member's failure to inform AEON Stores of any change.
- 9 Termination

- 9.1 The Member may terminate his/her Membership at any time by returning in person his/her Card to our Customer Service Counters at which time any Bonus Points accrued will be cancelled. Membership fees paid will not be refunded on termination of the Membership.
- 9.2 Misconduct, fraud, misuse of AEON MEMBER CARD, its benefits or failure to follow these terms and conditions may result in the immediate termination of the Membership and cancellation of all Bonus Points. AEON Stores reserves the right with or without notice and without giving reasons therefor to terminate the Membership at which time all Bonus Points accrued will be cancelled.
- 9.3 AEON Stores reserves the right, at any time and at its absolute discretion and without giving prior notice or reasons therefor, to
(i) Amend, withdraw or terminate any privilege(s) issued to a Member pursuant to the Membership or otherwise;
(ii) Suspend or cease to provide any service(s ) and/or privilege(s) originally enjoyed by the Member without compensation whatsoever; or
(iii) Terminate the Membership (and all Bonus Points accrued).
- 10 Liability

- 10.1 AEON Stores shall not be liable to any Member for any loss, damages or expenses of any kind whatsoever arising out of or in connection with the Membership, the use of the Card, AEON Mobile or its benefits, including but not limited to the use of personal data, mistakes or fraud by any person in redeeming a benefit, whether AEON Stores is negligence or otherwise.
- 10.2 AEON Stores’ liability in contract, tort or otherwise in respect of any claim arising out of acts or omissions relating to the Membership or the use of the Card or AEON Mobile shall be limited to re-crediting the value of the Bonus Points entitled to by the member in connection with which the matter arises.
- 10.3 AEON Stores will not be liable for any loss or damage arising out of the product or service provided by any other entities in connection with the use of the Card or AEON Mobile.
- 10.4 AEON Stores’ decision in respect of any such complaint or dispute shall be final and binding on the member and AEON Stores shall not be required to give any reason for such decision.
- 11 Invalidity

- 11.1 The invalidity, illegality or unenforceability of any provision of these terms and conditions under the laws of any jurisdiction shall not affect its validity, legality or enforceability under the laws of any other jurisdiction nor the validity, legality or enforceability of any other provisions herein contained.
- 12 Jurisdiction

- 12.1 These terms and conditions and the relationship between AEON Stores and each Member are governed by the laws of The Hong Kong Special Administrative Region. AEON Stores and each Member submit to the non-exclusive jurisdiction of the Hong Kong Courts.
**Should there be any discrepancy between the English and the Chinese versions of these terms & conditions, the English version shall prevail.
